Driver charged with drunk driving following accident

A woman who allegedly caused a serious accident was recently arrested for driving under the influence of alcohol. Police charged her with intoxication assault, a drunk driving charge that can carry steep penalties if she is convicted. Although she was initially taken into custody by Texas police, the driver was later released on $5,000 bail.

Shortly past midnight, the driver reportedly T-boned another vehicle. It is not clear if this collision was at an intersection, but the force of the wreck was apparently quite severe. A passenger in the vehicle that the driver supposedly hit suffered bleeding on her brain as well as skull fractures. The status of the other individuals in that vehicle as well as the driver accused of causing the accident were not readily available.

When speaking with police, the woman allegedly admitted to drinking wine during dinner. However, she also claims that she was under the legal limit while driving. She claims that she might have been better off using the ride-share service Uber, but again insisted that she was otherwise within the legal limits for driving.

Allegations of drunk driving are serious, and many of these charges hinge upon a driver's blood-alcohol content. However, Texas police may still make an arrest even if a person's BAC is below the legal limit or otherwise not available. This can be extremely disconcerting to defendants, but it does not mean that their situations are impossible. Defendants can generally obtain the most favorable outcome possible by taking an early and proactive response to their criminal defense planning needs, which can include reviewing all charges and possibly speaking with an experienced attorney.
